Introduction

On the first day of July 1971 his highness Sheikh Zayed bin Sultan Al Nahyan issued law No. 2 of 1971 for setting up the National Consultative Council of Abu Dhabi Emirate , and his highness opened the first session of the council on the third of October of the same year. The council consists of maximum fifty five members, with a period of membership of renewable two years. Its sessions are convened on yearly sessions, the period of the annual ordinary session is not less than eight months starts in the first week of November each year. His Highness the country Ruler or he who acts on his behalf attends the first session and presents the official opening speech. The council could be invited for extra convention if it has been required for The council bylaws show the most important tasks and the way they are performed. The general secretariat of the national consultative council is pleased to present to Their Excellencies the council members (the Directory of the member) detailing all benefits, rights and duties resulting from the council membership, and the general secretariat hopes this directory would contribute to the service of the members for the purpose of performing their great national mission.

First: Tasks of the National Consultative Council

The National Consultative Council performs its role and tasks according to the terms of its law articles and its bylaw. These terms mentions five tasks to be performed by the council:

1-Discussing the (local) draft laws:

This gives the council consultative legislative role in issuing the local laws referred to it from the executive council of the Emirate. Article 6 of law No.2of 1971obliges the executive council to submit the local draft laws to the National Consultative Council during its session for discussing the demand presenting its recommendations on them before submitting them to his highness the Ruler to order issuing them . In case of issuance of local laws during the holiday period of the council the executive council should inform it in the first meeting of its session after the end of the holiday.

2-Discussing public topics:

This task gives the council a king of control authority on the local public affairs under the supervision of the executive council to clarify the government policy on the topics related to the public activity in Abu Dhabi Emirate and expresses its desires and recommendations.

The internal system of the council on that regard necessitate the following:

  • Presenting written application signed from at least five members to submit the public subject for discussion before the council (filling the enclosed form n/g/17).
  • After deciding the application from the council the council head refers it to the chief of the executive council.
  • In case the executive council rejects discussing the subject or if there is no reply, the council decides to refer the subject to the competent committee for research and study.
  • The committee submit its final report o nit to the council for discussion if it ended studying it. if the committee still studying the subject it should submit a report for informing the council on the stages it took and request permission to follow up studying the subject.
  • After approving the recommendation are submitted to the council

3- Posing questions

This task gives the member of the National Consultative Council the chance to pose a written clear and brief question signed from him to the executive council chief or to a department head member of the executive council to ask about the internal matters under their task, or to ask about some thing, or to make sure of an event on which the questioner was informed, and comes within the control authorities of the council as regards the local public affairs.

4- Petitions and complaints

Within the framework of strengthening bonds between the council and citizens the council has the right to accept the petitions and complaints from people, whether individuals or groups, and request clarifications on them from the concerned parties.

5-Informing on the international treaties and agreements

The executive council informs the National Consultative Council on the international treaties and agreements made by the Emirate according to the terms of the Federal constitution.

Second : The council meetings

  1. The period of the legislative term of the council is two years starts from the date of the first meeting.
  2. The council holds in the legislative term two ordinary conventions sessions, the period of each is not less than eight months starts form the first week of November each year.
  3. Thecouncil hold its ordinary session upon an invitation issued by Emiri resolution.
  4. It is also invited by Emiri resolution for extra ordinary meeting for discussing subject determined in the invitation.
  5. Emiri resolution is issued for closure of the ordinary and extra ordinary sessions

Third :Acquiring the council membership and its tasks
Appointing the members

At the beginning of each legislative term of the council his highness the ruler issues Emiri resolution to appoint the council members , the membership term is two years (renewable) starts form the date of the first meeting , and those whose terms of membership expired may be appointed.

The membership tasks:

The member of the National Consultative Council performs his tasks determined by the council law and its bylaw as follows:

  1. Attending the council sessions and the meetings of its committees
  2. Submittig the public subjects to the council for discussion through a request signed by four members other than him.
  3. Taking part in the council discussions in the main sessions and in the committees meetings

Posing questions to the executive council chief and heads of the departments, and he has the right to comment on the answer.

The member has the right to read the minutes of the council committees.

The membership duties

The membership of the National Consultative Council imposes on the council member duties determined by the council law:

  1. The duties he gave oath to perform:

    • To be loyal to the county and the ruler
    • Respecting the laws
    • Seeking the good for the county and its progress
    • Performing his works at the council withal loyalty and honest

  2. Not to interfere in any of the acts of the judicial and executive authorities
  3. Not to be absent form attending the sessions , and he has to inform the council chief on the reasons of his absence.
  4. Getting permission from the council chief if he was obliged to be absence more than a month.
  5. Not to leave the sessions before its expiry except by permission from the chief
  6. Adhering to attend the meetings of the committees in which he participates

Discussion system in the session:

  1. Requesting permission form the council chief before speaking in the session.
  2. When permitted to speak in the session the member should not use inappropriate statements or touch the dignity of persons or agencies or harm the higher interest, or to perform a thing inappropriate to the system.
  3. The member should not interrupt the speaker nor speak with any one about personal matters
  4. The member should speak standing in his place inside the room or at the platform.

Immunity

The council membership grants the member two kinds of immunities

The first immunity:

The council member is free in expressing his opinions during performing his work in the council or its committees and he can not be blamed for that.

The second immunity:

During the convention of the session and arrested in a committing crime it not allowed to take any procedures of investigations or inspecting or arrest or any penalty procedure against the member except by permission from the council .

Forth: The role of the general secretariat in serving the council members

The main task of the general secretariat of the National Consultative Council is helping the council and its committees to perform the specialty assigned to them and presenting all facilities which could help the members perform their duties and roles. These services include:

  • Providing information, data and statistics requested by the members on the public subjects (filling the enclosed form n/g/19).
  • Providig the permanent committees members with the studies and research related to the subjects under discussing the committees ( filling the enclosed form n/g/15).
  • Informing the members on the times of sessions and meetings of the committees and providing them with the agenda and topics of discussion.
  • Handing the invitations to them embers to attend the official and public occasions to which they are invited.
  • Issuing or renewing passports for the members (filling the enclosed form n/g/18).
  • Providing postal office box to the member at the secretariat.
  • Specifiying e-mail for each member at the council.

Conclusion
